These Terms & Conditions ("Terms") govern access to and use of the services, software, communications tools, websites, APIs, AI systems, messaging systems, and related features provided by No31ab ("Hiveline," "Company," "we," "our," or "us") through Hiveline.live and related services (collectively, the "Services").

By creating an account, accessing, or using the Services, you agree to be bound by these Terms.

If you do not agree to these Terms, do not use the Services.

1. Eligibility

You must:

  • be at least 18 years old;
  • have authority to enter into binding agreements;
  • provide accurate account information;
  • comply with all applicable laws and regulations.

You may not use the Services if:

  • prohibited by law;
  • previously suspended or terminated by Hiveline;
  • using the Services for unlawful, abusive, fraudulent, or deceptive purposes.

2. Description of Services

Hiveline provides AI-powered business communication tools, including but not limited to:

  • AI receptionist services;
  • call answering and routing;
  • SMS messaging;
  • email communications;
  • voicemail handling;
  • AI-generated summaries and transcripts;
  • automation workflows;
  • customer interaction tools;
  • integrations with third-party services.

Features may change, improve, or be discontinued at any time. We do not guarantee uninterrupted availability of the Services.

3. AI Disclosure

You acknowledge and agree that:

  • communications may be processed using artificial intelligence systems;
  • calls, SMS messages, voicemails, and emails may be recorded, transcribed, summarized, analyzed, or automated;
  • AI-generated outputs may contain inaccuracies, errors, omissions, or misleading information.

AI-generated outputs are provided for informational and productivity purposes only and may contain inaccuracies, omissions, or other errors. Users are responsible for reviewing AI-generated content before relying on or acting upon it.

4. User Responsibilities

You are solely responsible for:

  • all communications sent through the Services;
  • uploaded contacts and customer data;
  • compliance with applicable telemarketing, SMS, privacy, recording, and advertising laws;
  • obtaining required permissions and consents;
  • monitoring communications generated by AI systems.

You agree not to use the Services for:

  • spam;
  • unlawful robocalling;
  • phishing;
  • fraud;
  • harassment;
  • impersonation;
  • deceptive marketing;
  • illegal surveillance;
  • abusive or unlawful activity.

We reserve the right to suspend or terminate accounts engaged in prohibited activities.

5. TCPA, SMS, and Calling Compliance

You are solely responsible for compliance with:

  • the Telephone Consumer Protection Act (TCPA);
  • CAN-SPAM Act;
  • applicable telecom laws;
  • SMS marketing laws;
  • do-not-call regulations;
  • local consent and privacy laws.

You represent and warrant that you:

  • have obtained all necessary consents before sending SMS messages or making calls;
  • maintain records of consent;
  • honor opt-out requests;
  • include legally required disclosures.

Users sending SMS communications must maintain functional opt-out mechanisms including keywords such as "STOP."

Hiveline is not responsible for unlawful messaging or calling activity conducted through customer accounts.

6. Email Compliance

Users sending email communications through the Services agree to comply with all applicable email marketing laws including the CAN-SPAM Act.

Commercial emails must:

  • contain accurate sender information;
  • use honest and non-deceptive subject lines;
  • include a functioning unsubscribe mechanism;
  • include a valid physical mailing address;
  • honor unsubscribe requests within legally required timeframes.

Hiveline reserves the right to suspend accounts generating excessive complaints, spam reports, or abusive sending behavior.

7. Call Recording & Consent

Certain Services may record or transcribe calls.

You are solely responsible for determining whether consent is legally required before recording communications in applicable jurisdictions.

You agree to provide all legally required notices and obtain all required consents before using recording or transcription features.

Hiveline disclaims all liability arising from unlawful recording or monitoring by users.

8. User Content & UGC Liability

Users retain ownership of content submitted through the Services ("User Content"), including:

  • messages;
  • emails;
  • recordings;
  • prompts;
  • scripts;
  • uploaded materials.

You grant Hiveline a limited license to host, process, transmit, and display User Content solely for operation of the Services.

You represent and warrant that:

  • you own or have rights to User Content;
  • User Content does not violate laws or third-party rights;
  • User Content is not defamatory, unlawful, or deceptive.

Hiveline does not endorse or assume responsibility for User Content.

9. Third-Party Services & Merchant of Record

The Services may integrate with third-party providers including:

  • telecom carriers;
  • AI providers;
  • payment processors;
  • email delivery providers;
  • CRM systems;
  • cloud hosting services.

Hiveline is not responsible for:

  • outages;
  • data loss;
  • interruptions;
  • third-party failures;
  • carrier filtering or message blocking.

Third-party services may have separate terms and privacy policies.

9.1 Paddle as Merchant of Record

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns, refunds, billing questions, chargebacks, and tax compliance on our behalf.

When you purchase a subscription or any paid feature from No31ab, you are contracting with Paddle for payment, and your transaction is also subject to Paddle's Buyer Terms and Refund Policy. For billing, payment, invoice, or refund inquiries, please contact Paddle directly at paddle.net.

10. Subscriptions & Billing

10.1 Subscription Terms

Certain Services are offered on recurring subscription plans. By subscribing, you agree to:

  • recurring billing;
  • the selected pricing plan;
  • applicable taxes and fees;
  • the minimum contract duration selected at checkout.

10.2 12-Month Minimum Commitment

Unless otherwise stated in writing, subscription plans include a mandatory minimum twelve (12) month commitment period. Early cancellation does not eliminate payment obligations for the remainder of the commitment term.

10.3 Auto-Renewal

Subscriptions automatically renew unless canceled before the renewal date in accordance with the cancellation procedures.

10.4 Cancellation

Cancellation requests must be submitted through:

Cancellation becomes effective at the end of the current billing cycle or contract term unless otherwise required by law.

10.5 Refunds

We offer a 30-day money-back guarantee on new subscription purchases. If you are not satisfied with the Services, you may request a full refund within 30 days of your initial order date.

Refunds are processed by our Merchant of Record, Paddle. To request a refund, visit paddle.net or contact hello@hiveline.live and we will assist you with the request through Paddle.

Outside of the 30-day window, renewals and partial billing periods are generally non-refundable except where required by law or at Paddle's discretion as Merchant of Record. Setup fees, if any, are refundable within the same 30-day window.

10.6 Failed Payments

We may:

  • suspend Services for failed payments;
  • charge late fees where permitted;
  • use collection agencies for unpaid balances.

11. Privacy

Your use of the Services is also governed by our Privacy Policy. By using the Services, you consent to the collection, use, and processing of information as described in the Privacy Policy.

12. Data Security

We implement commercially reasonable safeguards to protect information. However, no system or transmission method is completely secure. You acknowledge and accept the inherent risks of internet-based services.

13. Service Availability

We do not guarantee:

  • uninterrupted uptime;
  • error-free operation;
  • message delivery;
  • AI accuracy;
  • compatibility with all carriers or devices.

Service interruptions may occur due to:

  • maintenance;
  • outages;
  • telecom failures;
  • third-party disruptions;
  • force majeure events.

14. Intellectual Property

All rights, title, and interest in the Services, software, branding, trademarks, and technology remain the exclusive property of Hiveline and its licensors.

You may not:

  • copy;
  • reverse engineer;
  • resell;
  • sublicense;
  • exploit;
  • modify the Services without authorization.

15. Termination

We may suspend or terminate access to the Services at any time for:

  • violations of these Terms;
  • abusive conduct;
  • unlawful activity;
  • nonpayment;
  • security risks.

Termination does not eliminate outstanding payment obligations.

16. Disclaimer of Warranties

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY LAW, HIVELINE DISCLAIMS ALL WARRANTIES, INCLUDING:

  • MERCHANTABILITY;
  • FITNESS FOR A PARTICULAR PURPOSE;
  • NON-INFRINGEMENT;
  • ACCURACY;
  • RELIABILITY;
  • AVAILABILITY.

WE DO NOT GUARANTEE THAT:

  • AI OUTPUTS WILL BE ACCURATE;
  • COMMUNICATIONS WILL BE DELIVERED;
  • SERVICES WILL BE ERROR-FREE OR UNINTERRUPTED.

17. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, HIVELINE SHALL NOT BE LIABLE FOR:

  • INDIRECT DAMAGES;
  • LOST PROFITS;
  • LOST DATA;
  • BUSINESS INTERRUPTION;
  • REPUTATIONAL HARM;
  • REGULATORY FINES;
  • TELECOM PENALTIES;
  • CONSEQUENTIAL DAMAGES.

OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNTS PAID BY YOU TO HIVELINE DURING THE THREE (3) MONTHS PRECEDING THE CLAIM.

18. Indemnification

You agree to defend, indemnify, and hold harmless Hiveline, its officers, employees, affiliates, and partners from claims arising out of:

  • your use of the Services;
  • User Content;
  • TCPA violations;
  • spam complaints;
  • unlawful recordings;
  • privacy violations;
  • regulatory violations;
  • breach of these Terms.

19. Governing Law

These Terms shall be governed by the laws of Sweden, without regard to conflict of law principles.

20. Dispute Resolution & Arbitration

Any dispute arising from these Terms shall be resolved through binding arbitration on an individual basis.

You waive:

  • class actions;
  • jury trials;
  • representative proceedings.

Nothing prevents either party from seeking injunctive relief for intellectual property or misuse claims.

21. Changes to Terms

We may modify these Terms at any time. Updated Terms become effective upon posting. Continued use of the Services after updates constitutes acceptance of the revised Terms.
